The Lyme Listserv (the “Service”) is a community discussion forum for neighbors in Lyme, New Hampshire. By creating an account or otherwise using the Service, you agree to these Terms and Conditions (the “Terms”). If you do not agree to these Terms, do not create an account or use the Service.
The Service lets registered members post messages to a shared feed that is visible to other members, and lets members choose to receive email notifications of new posts. The Service is provided on an informal, community basis and is not a commercial product.
You are responsible for the accuracy of the information you provide when creating an account, for keeping your password confidential, and for all activity that occurs under your account. You must be able to form a binding agreement to use the Service.
Posts you submit to the Service are shared with other members of the listserv and, where you enable email notifications, distributed by email to other members. The Service makes no representation or guarantee regarding the privacy, confidentiality, or security of any content, message, or personal information you submit. You should not post anything you are not comfortable sharing with the community, and you use the Service at your own risk with respect to the privacy of your information.
The Service uses automated (AI-assisted) review to flag posts that may be inflammatory or inappropriate before they are submitted. This automated review is a best-effort tool only. It is not comprehensive, is not a substitute for human review, and does not make the Service a “moderated” service in any legal sense. The Service does not review, verify, endorse, or take responsibility for the content of any message posted by any member.
You are solely responsible for the content you post. To the fullest extent permitted by law, William John Hudenko, as the individual who operates the Service, is not liable for any message, statement, claim, or other content posted by any member, including content that is offensive, inaccurate, defamatory, or otherwise objectionable.
The operator of the Service reserves the right, in its sole discretion and for any reason or no reason, and without prior notice, to: (a) flag, hide, or remove any post or content; and (b) suspend, disable, or permanently remove any member account. This may be done with or without explanation.
The Service is provided “as is” and “as available,” without warranties of any kind, express or implied, including any warranty of merchantability, fitness for a particular purpose, non-infringement, or that the Service will be uninterrupted, secure, or error-free.
This Service is operated by William John Hudenko as an individual, and not by any company or organization. To the fullest extent permitted by law, William John Hudenko shall not be liable for any direct, indirect, incidental, special, consequential, or exemplary damages arising out of or in connection with your use of the Service, any content posted by any member, or any loss of data, however caused, even if advised of the possibility of such damages.
You agree to indemnify and hold harmless William John Hudenko from and against any claims, damages, losses, or expenses (including reasonable attorneys’ fees) arising out of your use of the Service or any content you post.
These Terms may be updated from time to time. Continued use of the Service after any changes take effect constitutes acceptance of the revised Terms.
These Terms are governed by the laws of the State of New Hampshire, without regard to conflict-of-law principles.
